If they've missed something or passed something they really shouldn't you can take it up with VOSA. I'd take it up with the seller if you feel you've been mislead. If it is under plastic trim or carpet then it may get missed as the MOT tester is not allowed to remove anything from the car to check condition. I've seen a few Fred Flintstone RRC with recent MOTs. Exmoor Beast Posted August 1, 2008 Share Posted August 1, 2008 Its amazing how rotten a Disco can be and still be considered structurally sound MOTwise. We looked at one a few weeks ago that had a new MOT and was a right dog underneath. Where is it rotten? We bought an Escort years ago from a garage that had done the MOT on it themselves before selling it. It was steering very strangely driving it home so I took it straight to a local garage and got it up on the ramps. It had a crack from the windscreen right down the bulkhead to the floor! I called the garage we bought it from and told them to get their backsides to us with a recovery truck and our cash back by the end of the day, which they did. Guest WALFY Posted August 1, 2008 Share Posted August 1, 2008 An MOT is a certificate to say that the vehicle was roadworthy at the time of the test. You could get a test on tyres and change them straight after. But as for corrosion if it was deemed that the rust/corrosion would of been present at the MOT and a failure then you have some grounds. old dave Posted August 1, 2008 Author Share Posted August 1, 2008 hi there thanks for your thoughts on my problem,I know I should not have got so excited at finding a nice looking disco I could afford, but there you are. the rust in this case is in the rear floor and the inner seals, perhaps these arnt mot failers. Hybrid_From_Hell Posted August 1, 2008 Share Posted August 1, 2008 An MOT only means that is WAS or should have been of an acceptable standard re the RTA Section 45 1988 on the day of inspection, The longer between the date of the Pass and your query now the more unlikley you'll get anywhere, and even so, the MOT Body (VOSA) only take much notice if the Pass date and you contacting them is within 28 days for mechanical and 90 days for severe corrosion and even then the suspisions have to be dramatic, if over 28 / 90 days forget it - even they aren't interested. If within 28 days of the pass then phone them on 0870 6060440. Even then the likley hood of you getting a bean is still questionable, they will prob say get stuffed as you ahve reported them to VOSA and they could lose there MOT Licence, however a chat with them about what you MIGHT do is prob your only hope of any compensation A Steep learning curve for you is the highest likley result sadly Nige Quote Link to comment Share on other sites More sharing options...

Although being road worthy and what it needs to pass an MOT can be two totally differant things Jules had a rangie and took it to a garage and asked for a list of what it needed to pass MOT . They did this and another list of what it needed to be road wrothy. The roadworthy list was alot longer than the MOT list Surprised both of us at the time.
