Looks like the end of RUPP's - straight to Restricted Byway status, no further upgrades to full Byway allowed, all existing outstanding claims to be nullified. Do not Pass GO do not collect £200 :(

NERC bill – response from Green Lane Association

Tuesday in parliament the NERC bill enjoyed its third reading, an action that would have passed most people by with little significance, yet in terms of civil and human rights its significance couldn’t be greater.

The legislation seeks to overturn one of the fundamental cornerstones of English and Welsh law, a tenet that has existed since the very beginning of highway law – Once a highway always a highway.

In law (Welsh and English law) a highway can currently only become declassified by a court ruling and then only by proving redundancy.

Wales and England have some 2,000 miles of RUPPs (roads used as public path) these are generally roads so neglected and in a state of disrepair that the majority of motor vehicles would struggle to navigate them.

The reason for the historic neglect of these roads is uncertain and shrouded in misinformation, what is clear however is that this government has backed down from its previous stance of supporting basic public rights and pressing local authorities to carry out their legal duty, to simply removing our rights of access.

The condition of these roads has inevitably attracted 4 wheel drive and off road motor cycle riders, what is clear is that declassifying will not stop illegal, irresponsible use, but will bring to an end; responsible users willing to maintain the roads of their own volition
