Could be something like oil seeping past the valve stem seals, if it clears and doesn't come back

How long do you need to leave it sitting before it happens on startup? minutes, or overnight?

it only does it when cold or should i say while the revs are higher than normal like its on fast idle this goes after a minute or so then perfect.it doesnt smell oily more like haft burnt deisel

Have you had any problems with non-start or the engine cutting out? One possibility might be fuel leaking into the cylinders either from a dud injector or past the copper washers that seal the base of the injector, though the latter is more likely to be accompanied by other problems i.e. non start.
