legality of exhaus exits

Bish is right - it must be in line with or slightly proud of the vehicle so that exhaust fumes can't enter the driver/passenger compartment. You can have the exit anywhere you like as long as it follows those rules.

In Australia, the exhaust must exit behind the last opening window if I recall correctly. Dunno what they say about lifting tailgates.

is there a hight limit? i heard that you cant have a side exit above a certain hight as it will blow fumes into lower cars open windows?

The point is that all these exhausts exit. They don't stop under the floor so when you are stuck i traffic the exhaust gasses are trapped under the vehicle and may find their way into the passenger compartment.
