Don't know if you know but if someone else crashes into your car the insurance company have no legal right to write off your car, as the damaged has been caused by others and you are claiming off their insurance they must repair it if you want it repaired. they will argue and say they don't but they (their member) has caused you the damage so they have to repair it. Its like someone coming along and taking your Landy off you and then saying here is 8k to cover it it's not allowed, so someone can't damage your property and then just offer to give you some cash, unless you chose to settle. they will put a lot of presure on you if it is badly damaged but have no right in law to write it off. If you had caused the acdient your insurance company can write it off as that is within your policy.

Mate of mine went through this with his S1 and after 3 months of legal got a full rebuild new chassis and complete respray looks very nice!!

Glad every one walked away, hopefully including the other driver as well.

With that damage, particularly to the chassis unless it was just the trailing arm, I suspect they will want to right it off. The rear axle looks seriously wonky so all the attachment points on the chassis and axle need to be checked. Body work cost a lot of money to straighten, and they would be required to fit new panels not just add 10kg of filler, that may make repairs cost more then the vehicle is worth.

See what they say but a cash pay out may be the best option, just make sure you strip all the good bits off before letting them take the vehicle (they aren't pay you for them so keep them), I suspect some one will be able to supply a set of just legal wheels and tyres which could be fitted before it went for instance. The pay out should be sufficient to let you buy a similar vehicle in at least as good a condition / mileage etc as your was pre accident.
